Welcome to Sweeps Dash. These Terms of Service ("Terms") govern your access to and use of the Sweeps Dash mobile application ("App", "Service", or "Application"). By downloading, installing, or using Sweeps Dash, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Application.

1. Acceptance of Terms

By accessing or using Sweeps Dash, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Sweeps Dash.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the Application or via email. Your continued use of Sweeps Dash after such modifications constitutes your acceptance of the updated Terms.

2. Eligibility

You must meet the following requirements to use Sweeps Dash:

• You must be at least 18 years of age
• You must have the legal capacity to enter into binding agreements
• You must not be prohibited from using the Service under applicable laws
• You must provide accurate and complete registration information

If you are using Sweeps Dash on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features of Sweeps Dash, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms or any applicable laws
• You engage in fraudulent, abusive, or harmful behavior
• Your account has been inactive for an extended period
• We determine that continuing your access poses a risk to our Service or other users

4. License and Intellectual Property

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Application on your personal mobile device
• Access and use the Application for your personal, non-commercial entertainment purposes

4.2 Ownership

Sweeps Dash and all associated intellectual property rights, including but not limited to:

• Software code, algorithms, and architecture
• Graphics, artwork, card designs, and visual elements
• Audio, music, and sound effects
• Text, content, and user interface design
• Trademarks, logos, and brand elements
• Game mechanics and gameplay concepts

are owned exclusively by Sweeps Dash or our licensors. You acknowledge that you do not acquire any ownership rights by using the Application.

4.3 Restrictions

You agree not to:

• Copy, modify, distribute, sell, or lease any part of the Application
• Reverse engineer, decompile, or attempt to extract source code
• Remove, alter, or obscure any proprietary notices or labels
• Use the Application to create derivative works or competing products
• Use automated tools, bots, or scripts to access or interact with the Application
• Attempt to gain unauthorized access to any systems or networks

5. User Conduct and Prohibited Activities

5.1 Acceptable Use

You agree to use Sweeps Dash in a manner consistent with all applicable laws and regulations. You will not:

• Engage in cheating, exploitation, or manipulation of game mechanics
• Use any unauthorized third-party software or modifications
• Harass, threaten, or harm other users
• Impersonate any person or entity or misrepresent your affiliation
• Transmit any viruses, malware, or other harmful code
• Interfere with or disrupt the integrity or performance of the Application
• Collect or harvest any personally identifiable information from other users
• Use the Application for any illegal or unauthorized purpose

6. In-App Features and Virtual Items

6.1 Virtual Items

Sweeps Dash may offer virtual items such as:

• Cosmetic enhancements (themes, card designs, backgrounds)
• Gameplay features or power-ups
• Achievement badges and rewards

These virtual items have no real-world value and cannot be exchanged for real money or any items of monetary value.

6.2 No Purchases or Refunds

All features in Sweeps Dash are provided free of charge. The Application does not include in-app purchases. Any virtual items earned through gameplay are provided "as is" without any warranty.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Sweeps Dash, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services and Links

Sweeps Dash may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for:

• The availability, accuracy, or content of third-party services
• The privacy practices or terms of third-party providers
• Any damage or loss caused by your use of third-party services

Your interactions with third-party services are governed by their respective terms and privacy policies.

9. Disclaimer of Warranties

Sweeps Dash is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Application will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of any content
• Warranties that defects will be corrected or that the Application is free from viruses

We do not warrant that the Application will meet your requirements or that any errors in the Application will be corrected. Your use of the Application is at your sole risk.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Sweeps Dash and its officers, directors, employees, agents, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption or loss of goodwill
• Damages arising from your use or inability to use the Application
• Damages resulting from unauthorized access to your account or data
• Damages arising from any third-party content or conduct

Our total liability to you for all claims arising from or related to these Terms or the Application shall not exceed $100 USD or the amount you paid us in the past 12 months, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Sweeps Dash and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Application
• Your violation of these Terms or any applicable laws
• Your violation of any rights of another person or entity
• Any content you submit or transmit through the Application

12. Updates and Modifications

12.1 Application Updates

We may release updates, patches, or new versions of Sweeps Dash from time to time to:

• Add new features or improve existing functionality
• Fix bugs, errors, or security vulnerabilities
• Enhance performance and user experience
• Comply with legal or regulatory requirements

You may need to update the Application to continue using it. We may automatically update the Application on your device.

12.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

13.1 Termination by You

You may stop using the Application at any time by uninstalling it from your device and discontinuing access to your account.

13.2 Termination by Us

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Request by law enforcement or government agencies
• Unexpected technical issues or security concerns
• Extended periods of inactivity
• Discontinuation of the Service

13.3 Effect of Termination

Upon termination:

• Your right to use the Application will immediately cease
• You must uninstall the Application from all devices
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

14. Dispute Resolution

14.1 Informal Resolution

If you have any concerns or disputes, please contact us first at support@sweepsdash.com. We will attempt to resolve the dispute informally within 60 days.

14.2 Arbitration Agreement

If we cannot resolve the dispute informally, you agree that any dispute arising from these Terms or the Application will be resolved through binding arbitration rather than in court, except that:

• You may assert claims in small claims court if they qualify
• Either party may seek equitable relief in court for intellectual property infringement

14.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the federal or state courts located in the United States, and you consent to the personal jurisdiction of such courts.

16. International Users

Sweeps Dash is controlled and operated from the United States. If you access the Application from outside the United States, you are responsible for compliance with local laws and regulations. We make no representation that the Application is appropriate or available for use in all locations.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sweeps Dash regarding the use of the Application and supersede all prior agreements and understandings, whether written or oral.

19. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.

20. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

21. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

By downloading, installing, or using Sweeps Dash, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. Thank you for choosing Sweeps Dash for your solitaire entertainment experience.
